1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and FuelPapa Australia ("FuelPapa", "we", "us", or "our") concerning your access to and use of fuelpapa.com, our mobile companion services, and related digital price discovery tools.

By accessing or using our platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the service.

2. Informational Service & Statutory Data

FuelPapa is a digital public utility designed to assist Australian motorists with fuel price transparency, cycle tracking, and road trip planning.

Our platform aggregates fuel prices through authorized statutory state reporting feeds (including the NSW Fair Trading FuelCheck gateway and WA FuelWatch API) alongside community contributions. While we make every effort to display real-time, accurate pricing:

• Fuel prices are set exclusively by independent retail service station operators and fluctuate continuously.
• A minor latency may occasionally occur between a physical board change and database synchronization.
• Always check the physical price totem and the pump meter display prior to dispensing fuel. The price displayed at the physical pump register at the moment of refuelling is the legally binding transaction price between you and the fuel retailer.

3. User Conduct & Community Price Submissions

When submitting station prices, reviews, or discrepancy reports to FuelPapa, you agree to:

• Provide truthful, accurate, and firsthand observations directly from the service station forecourt or totem.
• Not submit spam, automated bot data, commercial advertising, or maliciously distorted prices.
• Not engage in automated scraping, denial-of-service attacks, or reverse-engineering of our API endpoints without express written permission.

We reserve the right to suspend or permanently block IP addresses or user accounts that attempt to manipulate fuel data or disrupt service availability.

4. Intellectual Property & Nominative Fair Use

All proprietary software, branding, editorial guides, graphical assets, and map layouts on fuelpapa.com are the intellectual property of FuelPapa Australia and are protected by Australian copyright laws.

All third-party petroleum trademarks, trade names, and company logos (including but not limited to Shell, BP, Ampol, 7-Eleven, Metro Petroleum, United Petroleum, Liberty, Puma, Mobil, and Costco) displayed on this platform are the property of their respective owners. Their display constitutes nominative fair use solely for consumer station identification, geolocated map navigation, and comparative pricing transparency.

5. Third-Party Advertisements & Google AdSense

FuelPapa is funded through contextual advertising, including Google AdSense. Third-party advertisements displayed across our website do not constitute an endorsement, guarantee, or recommendation by FuelPapa of any third-party product, business, or service. Any interactions or commercial transactions with advertisers are strictly between you and the applicable third party.

6. Disclaimer of Warranties & Limitation of Liability

The FuelPapa platform and all content are provided on an "as-is" and "as-available" basis without warranties of any kind, whether express, statutory, or implied.

To the maximum extent permitted by Australian law:

• FuelPapa disclaims any liability for financial loss, vehicle detours, wasted fuel, mechanical breakdowns, or indirect damages arising from reliance on price information displayed on the website.
• We do not guarantee uninterrupted, bug-free, or server-continuous access to our interactive map or data feeds.

7. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of New South Wales and the Commonwealth of Australia. Any legal dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
